NOTICE OF EXECUTION SALE OF REAL PROPERTY FOR JUDGEMENT

UNDER AND BY VIRTUE of a Writ of Execution issued by the above named court in the above-entitled action on the 2nd day of February, 2018, directed to the undersigned Sheriff from the Superior Court of Macon County, I will offer for sale to the highest bidder for cash whatever right, title, and interest, the judgement debtor owns or may own in the following described real property which is subject to sale under execution.
The real property being sold is described as that described as that certain tract of land lying and being in the Highlands Township, Macon County, North Carolina, and being more particularly described in certain deed(s) recorded on 5th day of February 2016, in book CRP E-37, pages 91-93. Address given as 65 Eagle Ridge Road, Highlands, North Carolina 28741, parcel number 7541774798. Subject to all restrictions, reservations, exceptions and easements set forth in the all other registered play(s) and /or deed(s) related to this parcel.
This sale shall be held at the following location as designated by the Clerk of Superior Court: Front steps of the Macon County Courthouse, 5 West Main Street, Franklin, N.C on the 22nd day of May. 2018 at 12:00p.m. This property is being sold AS IS, WHERE IS and said sale shall be SUBJECT TO all superior liens, mortgages, easements, encumbrances, unpaid taxes and special assessments which were or became effective on the record prior to the lien of the judgement under which the sale is being held.
The judgement debtor HAS claimed his/her exemptions in this real property used as a residence or is not entitled to claim such exemptions. If the debtor has claimed, and is entitled to, the exemption, he/she is entitled to receive $35,000 ($60,00 for some debtors) in value from the proceeds of the sale of the property. Sales for an amount less than the exemption claimed shall not be final if subject to such exemptions. The sale shall be held open for (10) days for the filing of upset bids as required by law. No sale is final until confirmed by the Clerk of Superior Court of the issuing county.
The property may be subject to liens, debts, restrictions and /or conditions unacceptable to individual bidders. All bidders are encouraged to do a complete title search on this property PRIOR TO entering a bid. The Macon County Sheriffs Office, the Sheriff and Deputy Sheriffs, and the County of Macon make no representations or warranties of any kind or nature with regard to title to or suitability for any purpose or the condition of this real property.
